Terms and Conditions

Thank you for using the Jewellery by Mia website (the “Website”). This section provides you with information about the terms and conditions that govern your use of the Website (the “Terms and Conditions”). Customer satisfaction promise

If for any reason you are not completely satisfied with your jewellery please contact Jewellery by Mia by telephone or email to authorise your return. An authorised return must be sent to us in its originally packaging, and ensure that items are suitable protected, by Royal Mail Special Delivery as we cannot accept responsibility for parcels lost in transit. Please do this within 28 days of receipt stating whether you require an exchange or a refund. We will be happy to make a refund or an exchange providing the items are returned complete, in perfect condition and in their original packaging.
Unfortunately we are unable to accept the return of earrings in compliance with health and hygiene regulations.
If the items are faulty the refund will cover the cost of the item and that of the original postage and packaging and of the postage incurred by you when returning the item.
For bespoke items of jewellery alterations and repairs are free of charge up to 3 months from the date of purchase. Unfortunately we are unable to provide a refund or an exchange on bespoke pieces.
Jewellery by Mia will repair free of charge all accidentally damaged pieces up to 3 months from the date of purchase. If up to 3 months of purchase Jewellery by Mia feels that there is excessive damage or that the care instructions were not followed, a fee will be charged. After 3 months we will always endeavour to repair your item for you, however a small fee will be applicable.
We are only able to process returns and refunds when dealing with the original purchaser of the goods.

Late or lost deliveries

If you experience a problem with the delivery of your order please contact us and we will do our best to help you trace it. We will provide you with the Royal Mail tracking number so that you can enquire about your delivery with Royal Mail. In the event of a non-delivery, we can only replace or refund the order after 20 working days when Royal Mail will confirm that the parcel is lost. We cannot be held responsible for late or lost delivery.

Receipt of order

We must receive payment in full for your order before it can be accepted. Once your credit/debit card has been authorized, or your cheque cleared we will send you an email receipt confirming your order.
All items are handmade to order. In exceptional circumstances, if we are not able to fulfill an order we have accepted, your credit card will be re-credited or a refund cheque issued with the original price and we will notify you by email. In no circumstances will we be liable to you for any additional amounts.
We reserve the right to refuse to supply to any person for whatever reason. We also reserve the right to withdraw any goods from the Website at any time and/or remove or edit any materials or content on the Website. We will not be liable to you or any third party by reason of our: withdrawing of any goods from the Website whether or not such goods have been sold; removing or editing content on the Website, or, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Description of products

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. We take every care to ensure that photographs on the website are a true reflection of the product, however due to the nature of semi-precious stones there may be some slight variation in colour.

Passing of property

We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

Risk

Risk in the goods will pass to you upon delivery.

Delivery

All orders are dealt with as speedily as possible. Items which are in stock are usually dispatched within 3 working days of payment being received. If you require your order urgently it may be possible to dispatch your order the same day.
If there is a specific date you require your order to be delivered, please contact us with the exact date and we will advise you if we are able to meet your request. Specially commissioned items are dealt with on an individual basis.
We will deliver the goods in accordance with the delivery option selected by you during the order process. Please refer to our delivery options for further information.
Any delivery timescales quoted to you are indicative only and orders may be delivered to you in one or more deliveries.
Items up to the value of £2,500 are sent via the Royal Mail’s ‘Special Delivery’ service free of charge. This service requires a signature and is insured against loss and damage.
Special Delivery is guaranteed to arrive next working day. If you would like us to contact you prior to dispatch to arrange a delivery date, please let us know or make a note of this on the order form. If someone is not available to sign for the parcel a card will be left with instructions on how to arrange re-delivery or collect it from your nearest Collection Office.
Jewellery by Mia does not accept any liability whatsoever for delayed delivery caused by any third party.

Acceptance

Upon receipt of the goods you must inspect the goods and you will be deemed to have accepted the goods unless you notify us that you have cancelled the order and/or you return the goods in accordance with our returns & refunds policy. If no such action is taken, we shall not be obliged to accept any rejection of the goods at a later date. Your statutory rights are not affected.

Disclaimer

We work to keep the Website up to date but we cannot guarantee that the Website and its contents are completely free of technical errors. By using the Website, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with the Website. We are also not liable for any damages associated with use of the Website however caused, or incorrect prices or information appearing on the Website.

Customer responsibility

We cannot guarantee that the sale and delivery of our goods to your particular country or location is permissible, so please be aware of your own geographic import restrictions.
The Website and its contents will not constitute the basis for any contractual commitment between Jewellery by Mia and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of products by Jewellery by Mia would contravene any applicable local, regional or national legislation. No prospective customer should seek to make any order through the Website from jurisdictions in which it would be illegal for Jewellery by Mia to sell products.

Health & safety

You are expected to exercise all appropriate precautions to ensure that the goods provided by Jewellery by Mia are used only for the purpose for which they were intended. Our products are not toys and whilst every care is taken in the manufacture of our products they are, by definition, fragile and may be easily broken if mishandled. Further, it is obvious that component parts of each purchase may be readily detached unless handled properly and such component parts are extremely attractive to children. Care and common sense should be used to ensure that children in particular do not have access to any item or packaging that may result in them being harmed or injured in any way. Jewellery by Mia cannot, and does not accept any liability for any injury howsoever caused resulting from the supply or manufacture of any product.

Force majeure

Jewellery by Mia shall not be liable in respect of any shortage of or any failure to supply goods where such shortages or failure is due to Act of God, shortage of supply, riots, civil commotion, strikes, lock-outs, stoppages or restraint or withdrawal of labour for whatever cause whether partial or general or any other reason beyond the control of Jewellery by Mia and Jewellery by Mia in such circumstances shall not be liable in respect of any consequential loss to you.

Waiver

Any indulgence granted by Jewellery by Mia to you or any waiver by Jewellery by Mia of its rights under these Terms and Conditions in respect of any particular transaction or series of transactions shall not be deemed an agreement to confer the same indulgence or waiver of the Jewellery by Mia rights in respect of any previous or further transactions.

Indemnification

You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable legal fees, resulting from any third party claim, action, or demand resulting from your use of the Website. You also agree to indemnify us for any loss, damage, or costs, including reasonable legal fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on the Website infrastructure.

Termination

We may terminate or suspend any part of the Website at any time and without notice to you.

Entire agreement

You acknowledge and agree that these Terms and Conditions, together with our privacy policy, constitute the complete and exclusive agreement between us concerning your use of the Website and any purchase by you of any goods from Jewellery by Mia, and that these Terms and Conditions supersede and govern all prior proposals, agreements, or other communications between you and us.

Legal governance

Your use of the Website and any contract between you and Jewellery by Mia for the sale of products shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the Courts of England and Wales. If any provision within these Terms and Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of any remaining provisions.

Copyright and other rights

All materials, including images, illustrations, designs layout, photographs, written and other text or script that are part of the Website are protected by copyright, trade mark, trade dress and/or other intellectual property rights owned by, controlled by or licensed to Jewellery by Mia. The Website as a whole is protected by copyright, all worldwide rights, titles and interests in and to which are owned by Jewellery by Mia.
